New - UKHCA Guidance: Portability of Criminal Records Bureau Disclosures in England

The Department of Health (DH) has relaxed its position on the use of Criminal Record Bureau (CRB) Certificates, effectively introducing a limited system of "portability" for care services regulated by CQC. This applies in services provided to adults (but not children) in England and allows employers - under certain circumstances - to accept a Disclosure Certificate from a prospective employee, provided it is no more than 3 months old and is at the appropriate level. Here, the employer does not need to complete a new application for a Disclosure. UKHCA has produced guidance for members on using portability in homecare services, which includes recent DH and CQC guidance. [ID 300]

Materials developed for the homecare sector under thematic project

Belinda Siggers, Regional Assessor for United Kingdom Home Care Association, has developed a new range of materials for the homecare sector. The project was funded by accounting and professional services provider KPMG, and covers a variety of topical issues faced by domiciliary care organisations today. [ID 269]

There are new penalties for the employers of illegal workers who are employed on or after 29 February 2008, along with new requirements for employers if they are to avoid these penalties. These penalties and requirements apply in England, Wales, Scotland and Northern Ireland.

Douglas Mullen of Anthony Collins Solicitors LLP explained the changes in the March 2008 issue of Homecarer, and we are pleased to launch his revised Employer's Guide to the Prevention of Illegal Working, which explains the new rules in more detail and replaces the 2006 edition. [ID 59]
