TUPE is one of the most complicated areas of employment law that affects homecare providers. It can apply in many different types of situations and continues to evolve, as businesses change hands, service providers change, and councils outsource their homecare services. Assessing the effect of TUPE on a transfer is a key aspect of gauging the viability of a contract, both for the transferring and the transferee employer.
