The Department for Business, Energy and Industrial Strategy has revised its guidance on calculating the National Minimum Wage to reflect the Supreme Court's decision in Royal Mencap Society v Tomlinson-Blake.

The guidance explains that sleep-in workers are only entitled to National Minimum Wage when they are awake for the purposes of working, and includes examples of workers with working arrangements.

The guidance qualifies the examples by saying that each case may be different depending on individual circumstances, including what the contract provides and what is happening in practice.
